On July 14th, 2020, GessnerLaw, PLLC, filed an amended complaint on behalf of John Tyler Eugene Barnes, Jimmy Dean Duncan, Melissa T. Foreman, and all current and former outside sales representatives who are or have been employed by The Building Center, Inc. and its owners from 2017 to present.
The Verified Amended Complaint alleges that The Building Center, Inc., and its owners violated the North Carolina Wage and Hour Act (“NCWHA”), the North Carolina Commission Protection Act (“NCCPA”), the South Carolina Payment of Wages Act (“SCPWA”) for breach of written and oral contract, quantum meruit, unjust enrichment, unfair business practices, fraud – intentional misrepresentation and fraud – negligent misrepresentation.
Mr. Barnes, Mr. Duncan, Ms. Foreman, on behalf of themselves and all others similarly situated seek to recover lost wages, commissions, and other damages as allowed for by the North Carolina Wage and Hour Act (“NCWHA”), the North Carolina Commission Protection Act (“NCCPA”), the South Carolina Payment of Wages Act (“SCPWA”).
